By accessing or using Bench ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Bench is an AI-powered coaching platform that provides personalized guidance through specialized AI coaches. The Service includes a mobile application, web interface, and related features such as session management, outcome tracking, and third-party integrations.

3. Account Registration

You may use the Service with an anonymous device-based account or by creating an authenticated account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Subscription and Payments

Bench offers a free tier with limited features and a Plus subscription with expanded capabilities. Subscriptions are managed through Apple's App Store and are subject to Apple's payment terms.

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • You can manage and cancel subscriptions through your App Store account settings
  • Refunds are handled according to Apple's refund policy

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to reverse engineer, decompile, or disassemble any part of the Service
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use automated means to access the Service without our express permission
  • Share or resell access to your account
  • Use the Service to generate harmful, abusive, or misleading content

6. AI Coaching Disclaimer

The coaching provided by Bench is generated by artificial intelligence and is for informational and personal development purposes only. It is not a substitute for professional advice from licensed therapists, counselors, medical professionals, financial advisors, or legal professionals.

If you are experiencing a mental health crisis, please contact a mental health professional or call your local emergency services immediately.

7. Intellectual Property

The Service, including its design, features, content, and underlying technology, is owned by Bench and protected by intellectual property laws. You retain ownership of the content you create within the Service (messages, notes, captures).

8. User Content

You retain all rights to content you submit to the Service. By using the Service, you grant us a limited license to process, store, and transmit your content solely for the purpose of providing the Service to you. We do not use your content to train AI models.

9. Third-Party Services

The Service may integrate with third-party services (Notion, Oura, Apple Health). Your use of these integrations is subject to the respective third party's terms and privacy policies. We are not responsible for the practices of third-party services.

10. Limitation of Liability

To the maximum extent permitted by law, Bench shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Termination

We may terminate or suspend your access to the Service at any time, with or without cause. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately, though you may request export of your data.

13. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of significant changes through the Service or by other means. Your continued use of the Service after changes are posted constitutes acceptance of the modified terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Bench operates, without regard to its conflict of law provisions.
